AGREEMENT FOR SUBMISSION OF PHOTOGRAPHS:
In consideration of FuzziBunz™, its parent company Mother of Eden LLC, its and/or their successors and assigns posting a photograph of my child on the web-site at www.fuzzibunz.com, I, submitter of the photograph do hereby agree as follows:
1. That the name, address, telephone number and E-mail address of the submitter given in connection with submission of the photograph is correct.
2. That I, the submitter, have the legal capacity, as parent or legal guardian of the child whose photograph is submitted, to consent to posting of the child's image and do hereby consent to FuzziBunz™, its parent company Mother of Eden LLC, its and/or their successors and assigns posting said photograph at www.fuzzibunz.com.
3. That I, the submitter, have sufficient copyright interestin the photograph, and have not exclusively conveyed same to another, to consent to posting of same at www.fuzzibunz.com by virtue of:
a. having taken the photograph himself/herself;
b. the photograph having been taken by an employee to the submitter while in the course and scope of the employee's employment for the submitter;
c. the photograph having been taken pursuant to a written "work for hire" agreement between the photographer and the submitter;
d. being assignee of the copyrights in and to the photograph; e. having received the consent of the photographer or other owner of the copyrights to posting of the photograph at www.fuzzibunz.com; and, hereby consent to posting of said photograph, along with first name and age of the child only, at www.fuzzibunz.com.
4. I, submitter, do hereby release FuzziBunz™, its parent company Mother of Eden LLC, its and/or their successors and assigns of and from any all claims that I may have in any way arising out of or in any way related to posting of the submitted photograph, first name and/or age of the child and also agree to defend, indemnify and hold FuzziBunz™, its parent company Mother of Eden LLC, its and/or their successors and assigns harmless from any and all claims by others in any way arising out of or in any way related to posting of the submitted photograph, first name and/or age of the child.
5. I, submitter, understand and further agree that:
a. FuzziBunz™, its parent company Mother of Eden LLC, its and/or their successors and assigns does not guarantee that it will post the photograph being submitted;
b. if posted FuzziBunz™, its parent company Mother of Eden LLC, its and/or their successors and assigns reserves absolute discretion to remove the photograph at any time;
c. while FuzziBunz™, its parent company Mother of Eden LLC, its and/or their successors and assigns may, at its sole discretion, make reasonable efforts to remove photographs upon request of the submitter, it assumes no obligation to do so; and,
d. it any legal action should arise concerning this agreement same shall be governed by Louisiana Law, exclusive of its conflicts of law provisions and shall be brought and maintained in the State of Louisiana.
